As a result of several high profile employment cases involving large numbers of employees being granted compensation, Mitchells opened an Advice Centre for Employment in 2000 and now receives clients who are employees and employers nationwide.

Employees

We provide an initial advisory service for the full range of work related legal problems. If you are suffering from difficulties with your employment one of our advisors will be available to provide preliminary advice to assist you. If you have been dismissed or forced to resign your employment one of our solicitors will carry out an assessment of your case, normally free of charge, and advise you on the prospects of success. We often act for individuals on a 'no win no fee' basis.

Awards for compensation for unfair dismissal can be made up to around £50,000. Often substantial awards are made for sex, race and disability discrimination for humiliation and injury to feeling. While you normally (there are exceptions) need one year's service to bring an unfair dismissal claim, you can bring discrimination claims regardless of your service and you can bring it whilst still employed.

We are able to react quickly and file your claim on short notice to ensure you meet the critical 3 month deadline to bring your claim. We will give you step by step guidance on how your claim is progressing. We will provide advice as to the best option for you, including negotiating out of court settlements if appropriate.

Employers

Mitchells regularly act for employers providing practical advice and specialist representation. All work is carried out by qualified solicitors with extensive employment law experience. We are able to provide a complete employment law service on a fixed fee basis, including:

Procedural fairness is critical. It is important to take advice at each stage of the employment process. We can help you deal with awkward situations such as employees on stress or sick leave, what to do if a complaint of harassment is made, requests for family flexible hours, your legal obligations to a disabled employee, or how to implement restructuring your workplace. We can help you avoid a claim of unfair constructive dismissal.

You should take advice before taking any disciplinary steps against employees. We can provide step by step practical advice on how to proceed, and provide detailed disciplinary procedures for you and your employees if required.

You can achieve goals, whether dismissal, redundancy, disciplinary issues or restructuring without fear of an Employment Tribunal claim if you have the correct legal advice before you begin. Should any claim then be brought against you, we can help you defend it vigorously, with a good chance of obtaining costs against a vexatious applicant. We will always seek to provide the best practical outcome for you, including negotiating an economic settlement if this is appropriate.
